App: Outageloop (Jira Cloud, Atlassian Forge, with an external monitoring backend)

1. Agreement
These terms govern your use of the Outageloop app ("the App"), supplied by MernPearl Technology Private Limited ("MernPearl", "we", "us") through the Atlassian Marketplace. By installing or using the App you agree to them. If you install the App for an organisation, you confirm you are authorised to accept these terms on its behalf.
The App is distributed exclusively through the Atlassian Marketplace. It runs on Atlassian Forge together with a monitoring backend that MernPearl operates on Oracle Cloud Infrastructure in India. The Atlassian Marketplace Terms of Use apply in addition to these terms and govern purchasing, billing, refunds, and taxes. Where these terms conflict with the Atlassian Marketplace Terms of Use on those subjects, the Atlassian terms prevail.
Data handling is described in the Privacy Policy (https://outageloop.mernpearl.com/privacy) and, where applicable, the Data Processing Addendum (https://outageloop.mernpearl.com/dpa).
2. Licence
Subject to these terms and to a current Atlassian Marketplace subscription for the App, we grant you a non-exclusive, non-transferable, non-sublicensable right to install and use the App on the Atlassian Cloud sites covered by that subscription, for your internal business purposes, for as long as the subscription remains active.
We reserve all rights not expressly granted. You may not sublicense, resell, or make the App available to third parties as a service.
3. Restrictions
You may not:
- reverse engineer, decompile, or disassemble the App, except where that restriction is unenforceable under applicable law;
- circumvent or attempt to circumvent the tier limits described in §4, including by manipulating licensing data;
- use the App to attack, overload, or probe any third party, including by pointing it at systems you do not own or are not authorised to monitor;
- use the App in a way that breaches the Atlassian Marketplace Terms of Use, the acceptable-use terms of any monitored third-party service, or applicable law.
4. Plans and limits
The App is offered on two plans. The current limits are:

All in-Jira surfaces — the project board status strip, issue panel, issue-context badge, the global dependency matrix, and incident views — are available on both plans. The Free plan is limited by how much you can monitor and how far back you can look, not by whether the core functionality works.
These limits are current product configuration, not a contractual entitlement. We may adjust them, and may introduce further plans. Where a change materially reduces what your paid plan provides, we will give at least 30 days' notice as described in §12. Pricing and billing are handled by Atlassian under the Marketplace terms.
If you exceed a limit, the App refuses the action that would exceed it and tells you why. It does not silently drop data, and it does not delete anything you have already configured.
5. What the App is — and what it is not
This section is deliberately specific, because it describes the actual boundary of the product.
The App reports what third-party providers publish about their own services. Our backend polls the public status pages and status APIs of the services in the App's catalog, you choose which of them to watch, applies its own detection logic, and surfaces the result inside Jira. Its purpose is to help your team answer "is this outage us, or them?" faster.
The App is not:
- a monitor of your own systems. It observes nothing about your infrastructure, applications, or network. It cannot detect an outage of anything you operate.
- an independent source of truth about a third party. The App is only as accurate, and only as timely, as the vendor status page it reads. If a provider is down but has not updated its status page, the App will not report an outage. Providers may also publish incorrectly, late, or not at all.
- a guarantee of uptime — yours or anyone's. The App reports; it does not prevent, mitigate, or remedy an outage.
- a real-time alerting system. Status is refreshed on a polling schedule, so there is inherent latency between a provider's status changing and the App reflecting it.
Unknown status is a normal, designed outcome. When a status source is unreachable, returns an
unexpected response, or is blocked by the App's own egress and SSRF protections, the App records the
status as unknown rather than guessing. unknown means "we could not determine this", not "this
service is healthy".
Do not rely on the App as your sole signal for incident response. It is one input among several and should be treated as such.
6. Availability and support
The App depends on both Atlassian Forge and the Outageloop backend, which MernPearl operates on Oracle Cloud Infrastructure. Its availability is bounded by the availability of both, and we make no uptime commitment. While the backend is unreachable, statuses in the App stop updating; they are not reported as healthy.
Support is provided on the terms of our published Support Policy (https://outageloop.mernpearl.com/support). Those response targets are targets, not guarantees. There is no contractual service-level agreement, no service credits, no uptime guarantee, and no financial remedy attached to a missed target.
7. Third-party services
Our backend reads third-party status pages, and the App connects to Slack at your option. Those services are operated
by third parties under their own terms, and we do not control their availability, accuracy, content, or
continued existence. A provider may change or withdraw its status page at any time, which may cause the
App to report unknown for that dependency.
If you connect Slack, you supply your own bot token and your own workspace. Your use of Slack is governed by your agreement with Slack, not by these terms.
8. Your data and your responsibilities
You are responsible for the data you put into the App — in particular, which dependencies you attach to which projects and which Slack channels you configure. You are responsible for ensuring you are permitted to monitor the third-party services you select and to post to the Slack channels you nominate.
The App requests no scopes that permit it to write to, modify, or delete your Jira data.
9. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation.
Without limiting the above, and consistent with §5, we do not warrant that the App will detect any particular outage, that it will detect an outage within any particular time, that any status it reports is accurate or current, or that any notification will be delivered.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions this section applies to the fullest extent permitted, and nothing here limits any right you have that cannot lawfully be limited.
10. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the App, however caused and on any theory of liability.
- In particular, we are not liable for any loss arising from an outage the App failed to detect, failed to detect in time, detected incorrectly, or failed to notify you about, nor from any decision taken in reliance on information the App displayed.
- Our total aggregate liability arising out of or relating to the App is limited to the amount you actually paid for the App in the twelve (12) months immediately preceding the event giving rise to the claim. Where you use the App on the Free plan, that amount is zero.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
11. Term and termination
These terms apply from the moment you install the App and continue while your subscription is active.
- You may terminate at any time by cancelling your Marketplace subscription and uninstalling the App.
- We may suspend or terminate your licence if you materially breach these terms, or if we discontinue the App. If we discontinue the App we will give at least 90 days' notice, through the Atlassian Marketplace listing, on https://outageloop.mernpearl.com/support and, where we hold contact details for your site, by email.
- Atlassian may end your access under the Marketplace terms — for example on non-payment.
On uninstall, your data is deleted from both parts of the App. The Atlassian Forge platform clears the App's Forge storage (immediate soft-delete, a platform-managed relink window, then permanent deletion under Atlassian's retention policy), and the App tells our backend to delete your installation's records immediately, with an automatic 90-day backstop. Backend backups that contain them expire within 15 days. The Privacy Policy §8 describes this in full. Reinstalling within Atlassian's relink window may restore your Jira-side configuration; after it, your data is permanently deleted and cannot be recovered by us.
Sections 9, 10, and any accrued payment obligations survive termination.
12. Changes to these terms
We may update these terms. We publish every version at https://outageloop.mernpearl.com/terms with its "last updated" date. For a material change we give at least 30 days' notice before it takes effect, on that page and, where we hold contact details for your site (such as the technical contact of a paid Marketplace licence), by email. Continued use after a change takes effect constitutes acceptance. If you do not accept a change, your remedy is to cancel your subscription and uninstall the App.
13. General
- Governing law and venue: these terms are governed by the laws of India. Any dispute arising from or relating to them or to the App is subject to the exclusive jurisdiction of the competent courts of Rajasthan, India.
- Entire agreement: these terms, the Privacy Policy, the DPA where applicable, and the Atlassian Marketplace Terms of Use are the entire agreement between us regarding the App.
- Severability: if any provision is held unenforceable, the rest remains in force.
- No waiver: failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
